Terms of service

1. Agreement and provider

These Terms are an agreement between you and Daniel Fischlin, Husmattstrasse 2, 6416 Steinerberg, Switzerland, contact@mirrorstate.co, the operator of NightScene.

By creating an account, using NightScene or starting a paid membership, you agree to these Terms and acknowledge the Privacy Policy. The paid order flow asks you to confirm the Terms before continuing to Stripe.

NightScene is operated from Switzerland and initially offered to customers in the United States.

2. Eligibility and accounts

• You must be at least 18 years old and legally able to enter this agreement.
• Provide accurate account and payment information and keep your login secure.
• You are responsible for activity through your account. Contact us promptly if you suspect unauthorized use.
• One person may not create multiple accounts to repeatedly claim the free scene or bypass limits.

3. What NightScene provides

NightScene turns details you provide into an editable AI-generated visualization script. After you review the complete text, you may create a narrated audio and save it in your private library.

AI output can be incomplete, inaccurate or unsuitable. You are responsible for reviewing and editing every script before creating audio. NightScene may use automated moderation and refuse content that appears unsafe or prohibited.

4. Not medical care or therapy

NightScene is a creative visualization and listening tool. It is not medical advice, mental-health treatment, psychotherapy, crisis support or a promise of any outcome. Do not rely on it instead of qualified professional care. If you may be in immediate danger or crisis, contact local emergency or crisis services.

5. Your content

You retain any rights you have in the details and edits you submit. You grant NightScene a limited, non-exclusive permission to process that content only as reasonably needed to generate, moderate, narrate, store and deliver the service to you and to protect the service.

You confirm that you have the right to submit the content. Do not provide confidential information or another person’s personal information without authorization. Avoid unnecessary sensitive health, intimate, financial or identification data.

6. Free first scene

A new eligible account may create one finished audio scene without a payment card. The free scene has no cash value, cannot be transferred and may be limited or withdrawn in cases of misuse. Creating drafts alone does not promise an audio if safety or technical checks fail.

7. Membership, renewal and allowance

• The NightScene membership costs USD $14.90 per month, plus any taxes clearly shown at checkout.
• It renews automatically every month until canceled, using the payment method held by Stripe.
• Each paid billing month includes up to 10 newly created finished audio scenes. Unused scene allowances do not roll over and have no cash value.
• A scene allowance is used only when a finished audio is successfully created and saved. Reasonable draft and abuse-prevention limits may also apply.
• Saved scenes can be replayed without another scene allowance while they remain in your library and the service is available.
• Promotions or discounts apply only as stated in the offer and checkout confirmation.

8. Cancellation

You can cancel at any time through “Cancel or manage membership” in your NightScene account, which opens the Stripe billing portal. Cancellation takes effect at the end of the current paid billing period. You keep the paid membership allowance until then and will not be charged for the next period.

Canceling the membership does not automatically delete your NightScene account or saved library. You may request account deletion separately at contact@mirrorstate.co.

9. Refunds, taxes and currency

Except where required by applicable law or expressly stated in a specific offer, fees already charged are non-refundable and NightScene does not provide prorated refunds for a partly used billing period. If a duplicate or incorrect charge occurs, contact us promptly so it can be reviewed.

Prices are charged in U.S. dollars. Your bank or card provider may apply currency-conversion or international transaction fees. The checkout shows the charge before you confirm payment. You are responsible for applicable taxes unless the checkout states they are collected from you.

10. Acceptable use

• Do not use NightScene for unlawful, abusive, threatening, exploitative, deceptive or rights-infringing content.
• Do not attempt to bypass access, safety, rate or payment controls; probe the service; introduce malicious code; or interfere with other users.
• Do not resell, scrape, reverse engineer or systematically copy the service except where a restriction is prohibited by law.
• Do not present generated content as professional medical, legal, financial or emergency guidance.

11. Service changes and availability

NightScene may improve, replace or discontinue features and providers. Temporary interruptions can occur for maintenance, security, provider failure or circumstances outside reasonable control. If a material change adversely affects a paid membership, NightScene will provide notice or an appropriate remedy where required by law.

12. Suspension and termination

NightScene may suspend or terminate access for material breach, fraud, nonpayment, abuse or a security risk, normally after reasonable notice where practical. You may stop using the service at any time. Subscription cancellation and account deletion are separate actions.

13. NightScene intellectual property

NightScene and its licensors retain rights in the service, software, interface, brand, original content and voices. These Terms give you a personal, limited, non-transferable right to use the service. They do not transfer ownership of NightScene technology or third-party voice technology.

14. Disclaimers and liability

To the extent permitted by law, the service is provided on an “as available” basis without a guarantee that it will always be uninterrupted, error-free or suitable for a particular purpose. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

To the extent permitted by law, NightScene is not liable for indirect, incidental, special or consequential loss, loss of profits or loss caused by relying on AI-generated content. For other claims, NightScene’s aggregate liability is limited to the fees you paid for the service during the 12 months before the event giving rise to the claim. This limit does not apply where liability cannot legally be limited, including for intentional misconduct, gross negligence or personal injury caused by legally attributable fault.

15. Governing law and disputes

These Terms are governed by Swiss law, without depriving you of mandatory consumer protections that apply in your state or country. The ordinary courts at the operator’s domicile in the Canton of Schwyz, Switzerland, have jurisdiction unless mandatory law gives you another forum.

Before filing a formal claim, please contact contact@mirrorstate.co so the issue can be addressed directly. These Terms do not require arbitration and do not waive any non-waivable right to seek relief.

16. Changes and contact

NightScene may update these Terms for future use of the service. Material changes affecting an active paid membership will be communicated in advance where required. Continued use after the effective date of an update constitutes acceptance only to the extent permitted by law.
